GENERAL TERMS AND CONDITIONS
All the following terms and conditions apply to purchases made directly through the Buffalo Chip Computer Store in the CU Book Store at the University of Colorado-Boulder Campus and/or through our store web site. Technology product purchases of certain items within the Buffalo Chip Computer Store and/or through our Web site, including but not limited to personal computers and academic computer software, are restricted to qualified and academically-eligible customers as defined below in the section, “PURCHASING ELIGIBILITY”. Technology products featured on our Web page which require academic eligibility to purchase are designated “Academic purchase restriction applies” and are posted at the beginning of the product description. If the customer does not meet these academic purchase eligibility requirements, they may not proceed further with the purchase of restricted item(s). For purchases made through an Apple On-Line Education or Retail Store; Sony authorized retail store; Dell Retail Education site; and/or other applicable technology retail outlet, contact that respective company for their respective purchasing Terms and Conditions. The Buffalo Chip Computer Store is an authorized Apple, Sony, and Dell campus retail store. The Buffalo Chip Computer Store in the CU Book Store at the University of Colorado-Boulder Campus is solely responsible for advertising within the store and/or on the store’s web site. While we try to ensure accuracy of our product descriptions and advertising, we are not responsible for the inadvertent errors and omissions that it may contain.
PRIVACY NOTICE
The collection of personal identifying information for the purpose of transacting the sale of merchandise from the Buffalo Chip Computer Store and/or the CU Book Store and its subsequent marketing purposes, is conducted in strict accord with the University of Colorado polices, State of Colorado, and/or existing Federal statutes. The store may not in any manner, sell, transfer, or otherwise transfer such information to any of its suppliers, manufacturers, or other interested third-party sources without written permission of the applicable individual. However and as it applies to the sale of restricted, academic-eligible products, the store may and the purchaser agrees without written consent, to permit disclosure of all proofs of academic purchase eligibility and/or personal identification information on sales documentation when demand is placed upon the store by the respective technology manufacturer/software publisher to ensure through audit, compliance with the restricted purchasing provisions of existing contracts with the University. If the purchaser wishes not to divulge this information at the time of sale, the purchase transaction must not be completed.
PRODUCT SPECIFICATIONS
Computer and software technical specifications are the sole responsibility of the manufacturer and are subject to change without notice. The end-user purchaser is always responsible for assuring themselves that the product operating requirements and specifications are suitable for their needs. Maximum purchaser satisfaction will be achieved by seeking out manufacturer and University sources (Information Technology Services, etc.) of information on product operational requirements, specifications, and limitations. However when sales staff verbal guidance and/or the written product descriptions on our Web site are given which is contrary to that of the published manufacturer specification and system performance or operation requirements, the manufacturer’s published guidance always takes precedence. This published guidance is usually printed on the product box, direct from the manufacturer’s Web site, and/or any other external technical literature. Additionally, mail-in rebates programs are offered from time-to-time by participating technology manufacturers and software publishers. The decision to offer these rebate programs and the specific Terms and Conditions including determination of purchaser eligibility; and the proper process for fulfillment of the rebate rests solely with the respective manufacture. The purchaser assumes all responsibility for proper completion of any rebate form and timely submission to the applicable manufacture. The store is not obligated in any manner to participate in any rebate program and is not responsible for fulfillment of the rebate if for any reason, the manufacturer or publisher denies payment of the rebate to the purchaser.
PRICING/AVAILABILITY
Pricing and availability are subject to change without notice. In-store inventory is limited; sales are strictly first-come, first-served. It is store policy not hold merchandise in storage awaiting arrival of the customer for any reason. Should store inventory be exhausted prior to the receipt of an order via our Web site, the store will contact the purchaser with the estimate date of arrival of additional inventory or give the purchaser the option to cancel their order. Should a product be discontinued by the manufacturer for which a customer has an outstanding order placed, the store will attempt to find a suitable item, at a comparable price, in order to satisfy the order. Again, the store will contact the customer to secure agreement to accept the replacement product or give the customer the option to cancel the order. Promotions are done on a limited time basis and are also subject to termination as specified in the promotional literature. Promotions may also carry additional Terms and Conditions which the customer must adhere to. Prices do not include sales taxes, shipping/insurance charges and/or possible cash discounts. Cash discounts if any, are applicable solely to the purchase of a qualifying computer exclusive of accessories, software, displays when not purchased with a computer, and/or other associated peripherals, and only when purchased through the Buffalo Chip Computer Store using cash or check (no credit cards, including CU departmental A-Cards). Cash discounts can be terminated without notice at the discretion of the store. When a price discrepancy for technology products exists between any external marketing material and that reflected on the store’s Web site and/or cash register, the prices reflected on the Web site and/or cash register are always considered correct and take precedence. Price changes which are announced after an order has been released to the shipping carrier are not retroactive and will not be adjusted by the store.
PRICE MATCH/PRICE GUARANTEES
The Buffalo Chip Computer Store in the CU Book Store does not participate in any price match or price guarantee programs. Customers are highly encouraged to compare prices, according to each product feature, at other retail stores including on-line retailers, before concluding a purchase with the Buffalo Chip Computer Store, to ensure that product pricing is not an issue. Written price quotes (sales literature, advertising, etc. is not considered a written price quote) are valid and will be honored by the store for a period not exceeding fourteen (14) calendar days from the date on the written price quote.
PURCHASING/PAYMENT
The Buffalo Chip Computer Store in the CU Book Store accepts walk-in and telephone orders, as well as Web orders for selected merchandise on the store site. For telephone purchases for which a check is being mailed, the order cannot be shipped until the check has been received and cleared the financial institution. Please allow a minimum 10-14 days delay for purchase transactions when using personal checks for payment. If personal check payment is being made on behalf of another (i.e. student), please ensure that the students CU ID number is included on the check, along with the other information requested below. Checks received without all of the required information will be returned. The store does not accept third-party, business or commercial checks. Additionally, orders placed via our store Web site require payment with a major credit card (checks are not permitted) and for CU departmental Web orders; payment can only be made with A-Card. Payment for purchases must be in U.S. funds. If payment is made by personal check, bank cashier’s check, etc., please make payable to “CU Book Store”. Personal checks must reflect current CU ID Card, number of the check, along with current/residence, telephone number and full name of the purchaser imprinted on the personal check. A $17 return fee will be charged for all checks returned from the financial institution if dishonored. The store offers no financing or extended term payment plans and cannot bill purchases against student tuition accounts. Purchases are made strictly on a cash and carry basis.
PURCHASING ELIGIBILITY
Many technology products, especially personal computers and academic computer software offered by the store, are restricted by the applicable manufacturer and/or software publisher to eligible academic purchasers. These restricted purchase products are identified on our store Web site, at the beginning of the product descriptions as, “Academic purchase restriction applies – click on Terms and Conditions link below”. By purchasing technology products through our store and/or through our Web site, the purchaser acknowledges and agrees that they have read and understand these Terms and Conditions, and certifies that they are an eligible student, faculty, staff member and/or are purchasing on behalf of a department of the University of Colorado system (any campus), or are purchasing on behalf of another eligible member, such as an inbound, new or transfer student to the University of Colorado as further defined below. The store cannot sell restricted academic products to institutions outside of Colorado; private, for-profit educational entities regardless of location; Colorado K-12 schools; and/or to any state or federal affiliated individual/agency outside of the University of Colorado system. Commercial business activities and non-profit entities, regardless of location, are strictly barred from purchasing from the store. Purchaser furthermore agrees to produce upon demand by the store, an acceptable form of personal identification and proof of academic eligibility before the sales transaction can be completed. The store uses internal authentication processes to validate a purchaser’s academic status and purchasing eligibility. Eligible University of Colorado system higher education customers are defined as: All departments and other organizational entities of the University of Colorado system; all newly admitted (in possession of a Non-Refundable Tuition Deposit Receipt) and currently enrolled students, including Continuing Education and Distance Learning students with paid tuition paid receipt; all faculty and staff, including those assigned to University of Colorado system affiliates. Some technology manufacturers permit extension of purchasing eligibility to include University Alumni and retired faculty and staff of the University of Colorado. Customers of this type must contact the store to validate their eligibility before attempting a purchase of restricted product. In those instances where high school students are planning to make a computer and/or software purchase in preparation for entry into the University of Colorado system (all campuses), contact the Buffalo Chip Computer Store for assistance in determining purchasing eligibility. The purchaser also agrees to hold the CU Book Store and the University of Colorado harmless and without liability if upon subsequent order processing review, the store declines purchaser’s order because it was determined at the store’s sole discretion, purchaser was an ineligible education customer
PURCHASING RESTRICTIONS
Purchaser further agrees that the purchase is strictly for personal and departmental educational use and a restricted purchase cannot be traded, transferred, or immediately resold in pursuit of any private, non-educational trade or business enterprise. Shipment of computers and/or software cannot be made by the store to any destination outside of the United State of America or its territorial possessions.
RETURNS
No returns are permitted for any reason for purchases made through a manufacturer’s on-line store and/or any manufacturer’s retail store. These return transactions must be conducted with the store where the purchase originated. For computer and software purchases made directly through the Buffalo Chip Computer Store or through the store’s Web site, no returns of any computer or software are allowed except for those that are out-of-the-box defective OR where the original manufacturer’s factory seals have been unbroken and remain in-place. “Out-of-the-box defective” means that the purchaser has three store business days from date of sales receipt or in the case of an item shipped, the date of delivery on the signed delivery receipt, to determine that the computer has a manufacturing defect that prohibits the proper operational use of the computer. Customers with valid returns must always provide a dated store sales receipt to establish proof of purchase. Valid returns must also always be accompanied by all associated packaging and packaging materials in order to receive full credit. Customer satisfaction issues are never justification for an open-box computer or software return and will be refused by the store and returned to the purchaser at the purchaser’s expense. The store fully expects that the purchaser has availed themselves of all necessary sources of technical information and compatibility requirements to make an informed decision before the actual purchase. If in doubt, don’t make the purchase. In the case of material defect, contact the store for guidance and a RMA number before returning product. The store reserves the right to assess a $50 restocking fee for computers (unopened, manufacturer’s outer seals-in-place) and a 15% restocking fee for software returns (unopened, manufacturer’s outer seals seals-in-place) that are not out-of-the-box defective.
SHIPPING AND INSURANCE
Shipping prices are calculated during the checkout process based on the weight of the combined items and the destination zip code. All computer shipments include insurance and require signature upon delivery. Purchasers are cautioned to inspect the shipment carefully for missing items or obvious physical damage prior to signing the carrier delivery receipt. If there is damage or missing merchandise, STOP and immediately advise the carrier of the problem. Retain all shipped merchandise, together with all shipping materials, until the carrier has properly inspected the shipment. Once the delivery has been accepted, the store assumes no further liability for in-transit damage or missing merchandise. The store however, will assist purchasers with a proof of delivery receipt upon request by the purchaser.Deliveries are not made on Saturday's or Sunday's. Please note that UPS and FedEx cannot deliver to PO Boxes. UPS is the preferred shipping method.

Properly completed orders will be shipped according to service guidelines. Orders are properly completed after credit card authorizations are obtained and shipping address is confirmed. The CU Book Store reserves the right to hold any order suspected of fraud. Orders that cannot be properly completed shall be cancelled and affected customers will be notified.
